ACKNOWLEDGEMENT AND ASSUMPTION OF RISK AND RELEASE
I, , acknowledge that I am volunteering to work for the Aspen Chamber Resort Association, Inc. (“ACRA”) as a volunteer for the Food & Wine Classic in Aspen (the “Event”). I understand I am not an employee of ACRA and, as such, I am not entitled to or eligible for compensation or employee benefits, including Workers’ Compensation Benefits. (Those ACRA employees on ACRA’s payroll will be covered by ACRA’s Workers’ Compensation to the same extent they are regularly covered.) In consideration for allowing me to volunteer for ACRA and attend this Event, I agree to all the terms and conditions set forth in this Food & Wine Classic in Aspen Acknowledgement and Assumption of Risk and Release (this “Agreement”).
COMPLIANCE
At all times during the Event, I will fully comply with (A) all rules, policies, and directions of the Event and/or ACRA, including the then-current Classic in Aspen Code of Conduct (currently available at https://classic.foodandwine.com/eventcodeofconduct/, subject to change at any time in People Inc.’s sole discretion); and (B) all applicable federal, state, and local laws, regulations, and rules. I confirm that I am in good health and in proper physical condition and do not have any medical or other conditions that would impair my ability to volunteer for this Event. If at any time I believe conditions to be unsafe or that I am no longer in proper physical condition to volunteer, I will discontinue further participation in the Event. I acknowledge that ACRA is relying on these statements to allow me to participate in the Event. I acknowledge and agree that ACRA reserves the right to dismiss me as a volunteer at any time for any reason.
ASSUMPTION OF RISK AND WAIVER OF LIABILITY
I acknowledge and understand that my presence at and participation in the Event carries certain inherent risks, including, but not limited to, the risk of property damage, serious personal injury, disability, and/or death. Without limiting the generality of the foregoing, I recognize that my presence at and participation in the Event may include lifting heavy objects (including moving furniture), operating vehicles or other motor equipment, assembling or otherwise readying staging and other Event spaces (which may involve the use of power tools), exposure to hidden obstructions or natural and manmade objects present at Event location(s) which may be dangerous to persons, exposure to the elements, and exposure to diseases of contagious nature. I further recognize that during the Event there will be opportunities to taste wines and that consumption of alcohol, even in small amounts, has risks to my health and safety, and can cause physical or mental impairment that has risks to the health and safety of myself and others. I understand that there are methods of tasting wine without excessively ingesting alcohol. I also know that I should not, and agree that I shall not, drink and then drive a motor vehicle. I agree that I will take full responsibility for the consequences of my own alcohol consumption at the Event.
Having considered the aforementioned risks and liabilities, I hereby freely, knowingly, and voluntarily assume all risks and liabilities that may be associated with and/or result from my involvement in or attendance at the Event, including, but not limited to, travel to and from the Event and attendance at the volunteer party. I acknowledge and agree that I shall in no event be entitled to recover any damages or other amounts from any individual or company associated with the Event (including, without limitation, Dotdash Meredith, Inc. aka People Inc. and its subsidiaries. (“People Inc.”), ACRA, and each of their respective parent companies, subsidiaries, sponsors, affiliates, officers, directors, agents, servants, contractors, and employees (collectively, “Releasees”)) for any matter, including, but not limited to, injury, pain, suffering, or damage to myself or any person or property resulting from any of the activities pertaining, directly or indirectly, to the Event (or any portion thereof). I hereby release, to the fullest extent permitted by law, and agree to indemnify and hold harmless the Releasees from and against any liabilities, claims, demands, actions, causes of action, losses, damages, or injuries (including death) that may be sustained by me or by others on account of me as a result of my participation in or attendance at the Event regardless of whether any such loss, damage, or injury is the result of negligence and/or breach of warranty (express or implied) on the part of the Releasees. I hereby covenant not to make or bring any demand, claim, suit, action, cause of action, or like proceeding against any Releasee, and forever release and discharge the Releasees from liability under any such demand, claim, suit, action, cause of action, or like proceeding.
I authorize personnel for the Event and ACRA to call medical care for me and/or to transport me to a medical facility or hospital of their choosing if, in the opinion of such personnel, I am in need of medical attention. I agree that neither People Inc. nor ACRA shall have any responsibility for calling for or transporting me to medical care, and I shall indemnify and hold harmless the Releasees from and against any costs incurred in any effort to provide me with, or transport me to a place to receive, medical attention, and I shall reimburse the Releasees for any such costs upon demand.
I acknowledge and agree that People Inc. and ACRA may collect and use my personally identifiable information for purposes related to the Event. I hereby grant People Inc. and ACRA (and their parent companies, affiliates, employees, contractors, and licensees) the irrevocable, transferable, perpetual, royalty-free right and license throughout the universe to record (by photographs, film, tape, audio recording devices, and any other method or device) my attendance (including my name, voice, image, and/or likeness) at the Event (the “Recordings”), and, notwithstanding anything to the contrary contained herein, to use, modify, copy, distribute, and exploit such Recordings for any and all purposes, in any and all media, formats, and methods of transmission now known or hereafter developed.
This Agreement, and the assumption of risk and release of liability contained herein, shall be binding upon my assignees, distributees, heirs, next of kin, executors, and administrators and may be pled by People Inc., ACRA, and/or the other Releasees as a complete bar and defense against any demand, claim, suit, action, cause of action, or like proceeding by or on behalf of me.
I have carefully read this Agreement, and I know and understand what it means. My signature below is of my own free act, and I intend it to be legally binding upon me. This Agreement represents the entire understanding between People Inc., ACRA, and me regarding the subject matter hereof and supersedes any other statements, agreements, or representations, whether written or oral regarding the subject matter. I agree that, if any portion of this Agreement is determined to be unenforceable by a court of law, the court should enforce the remainder of this Agreement without regard to such provision. I hereby agree that this Agreement is intended to be as broad and inclusive as permitted.
MISCELLANEOUS
I hereby agree that this Agreement represents the full understanding between ACRA and me and supersedes all other prior agreements, understandings, representations, and warranties, both written and oral, between us, with respect to the subject matter hereof. If any term or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction, that term or provision shall be deemed modified so as to be valid and enforceable to the full extent permitted. The invalidity of any such term or provision shall not otherwise affect the validity or enforceability of the remaining terms and provisions. This Agreement is binding on and inures to the benefit of ACRA and me and our respective heirs, executors, administrators, legal representatives, successors, and permitted assigns. I hereby agree that this Agreement is intended to be as broad and inclusive as
permitted, and that this Agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado, without reference to any choice of law doctrine.
